What is software piracy?
Software piracy is the illegal copying
and/or distribution of a copyrighted software program. Use or even possession of
an illegal copy is also software piracy.
Types of Software Piracy
- End-User piracy: Users copy software
without appropriate licensing for each copy. This includes companies who do
not monitor the number of licenses and allow more than the maximum number of
users to install copies of licensed software. Users who put a copy of their
work software on their home computer, or vice-versa are also violating the
license agreement.
- Hard Disk Loading: Unauthorized copies of
software are installed on computer hard-drives prior to sale. If no license
information or serial number accompanies such a copy, it is likely to be
pirated.
- Internet Piracy: Unauthorized copies are
downloaded over the Internet. If serial numbers and downloads are made
available on the Internet, make sure that the publisher has authorized this
distribution.
- Counterfeiting: Making and distributing
illegal copies of software in packaging that reproduces the manufacturer’s
packaging. Counterfeit registration cards with unauthorized serial numbers
are often included in these packages.
- Online Auction Piracy, which takes several
forms, such as:
- Software resold in violation of the
original terms of sale. Academic sold as commercial, NFR (Not For Resale),
volume licenses, or OEM software is never authorized for resale by the third
party.
- Seller offers software for sale in
quantity and is not an authorized reseller or otherwise licensed to
reproduce or distribute sap software.
- Earlier versions of software that have
been used to obtain an upgrade to a later version are not transferable to a
new owner, per sap license agreements.
Results of Software Piracy
Users of pirated software should be aware
of the following:
- Pirated software cannot be upgraded to
later versions.
- Technical Support is not available for
pirated versions.
- You may have purchased an incomplete or
out of date version of the software.
- Viruses often accompany illegally
distributed software.
- Legal prosecution for Intellectual
Property Law infringement can result in arrest, felony charges, up to five
years in jail and fines of up to $250,000.
How to protect yourself from Software Piracy when purchasing
on eBay
- If you are buying a used copy, check to
see if the software has been registered. Get the serial number and name of
the user and contact sap to see if the software is registered in this name.
Verify that the seller can legally transfer ownership to you.
- If the owner has used this copy to upgrade
to a newer version, the license will not allow transfer of the earlier
version license to another user. Installing an upgrade version forfeits the
original license.
- sap requires any reseller who is selling
sap educational software to be a part of the sap Authorized Academic
Reseller (SAAR) program. To ensure that the eBay seller you wish to buy from
is authorized by sap, you can check at www.sap.com or send an email to tip@sap.com.
- Only an authorized Academic reseller can
sell academic software and must verify the academic status of the purchaser.
If resold, the seller must clearly state the software is academic and must
verify eligibility of the buyer, prior to sending the software. For more
information, please see http://www.sap.com/resources/education/requirements.html.
- Volume licenses cannot be resold, and are
never sold as separate copies to individuals. If the seller claims these are
"extra" licenses for resale, they are not legitimate.
- Selling backup copies is illegal,
regardless of any legal "disclaimers" or other claims by the seller.
- Register your software with sap when you
receive it.
- Keep your receipt and your copy of your
registration card. These will allow you to verify that you have a legal copy
of the software.
To report suspected piracy, please email tip@sap.com
or call +91-656-4512. All reports are kept confidential.
